Modifying Court Orders

A Request for modification of a court order is often necessary when there is an earlier determination of Custody, Support or other orders that might be affected with a change in circumstances of either party.

For example, a client contacted the office one day and explained that his ex-wife had lied to the court about her income. At the time the original order was signed by the judge, the client was unable to gather the necessary proof to demonstrate his ex-wife’s true earnings. Almost 2 years later he learned that his ex-wife earned a substantial amount more then she had represented to the court. After careful research, we explained to the client that the Superior Court has jurisdiction to modify the court order to increase the amount of support owed by the ex-wife. In addition the client decided that he wanted to petition the court order that the ex-wife pays back due support in an amount to compensate for what she should have paid over the 2 year time period.

There are at least 2 processes that allow a party to modify child support obligations and others that may require specialized pleadings of which we enjoy creating. The first process requires that the circumstances calls for the child support determination to be changed by a minimum of 15 percent. The second is more specialized and depends on an articulated position to prevent an injustice from occurring or continuing.

25- 502. Custody and Parenting Time (“Visitation”) is also subject to Modification depending on the changed circumstances that may affect the current order. Similar to the processes for modification of support obligations, the Superior Court has jurisdiction to determine if a new order for Custody or Parenting Time (“Visitation”) is in the best interest of the minor child.
