Annulment (Arizona):
An annulment is a legal process whereby Arizona state Superior courts may dissolve a marriage, and may adjudge a marriage to be null and void when the cause alleged constitutes an impediment rendering the marriage void. The main difference between a Dissolution of Marriage “Divorce” and an Annulment is that the latter brings you to a status of never having been married.
We once had a client who was married for 7 years but because his religion prohibits “Divorce” he wanted to get an annulment. Initial response by the opposing party was the only reason the petitioner requested an annulment and not a divorce is to escape having to share community property. First, that was far from the truth because the law in this state treats property issues the very same as if the parties’ wanted a “Divorce” instead of an Annulment. The Judge in the case was perfectly willing to grant the annulment, unless the other party objected. The issue of community property was dispositive and decided despite the grant of an annulment.
Fortunately, the parties’ finally reached an agreement allowing Arizona Legal Specialists to Draft a Property Settlement Agreement that they believed fairly disbursed of the community Property. Once a judge signs the Decree of Annulment and the attached settlement agreement, the 1st Court Order is in effect.
