Divorce for a Non-Covenant Marriage - With Children
Dissolution of Marriage (Commonly referred to as Divorce):

The Final Decree of Dissolution severs the parties Marriage. There are two methods of getting the 1st court order for a divorce.

First, the parties may get an order for a decree of Dissolution if they agree that the marriage is irreconcilable or there is no reasonable prospect of reconciliation. This method is called a consent decree, which requires that both parties to the Divorce proceeding file a petition and/or a response before the court will sign the consent. Often times our clients will request a property settlement agreement when the parties can agree on a distribution of property.

The second method of obtaining a Divorce is by Default. Default occurs when the responding party to the complaint fails to file an answer to the petition within the time proscribed by law.
