Grandparents Visitation

In some cases, grandparents may exercise their rights to visitation with a grandchild that the child’s parent may or may not have custody or visitation rights with themselves. In other cases, the child’s parent may be deceased and the grandparents may seek to establish their own visitation rights with the minor child. In such cases, Arizona law allows a grandparent to petition the Superior Court within the county where either party resides.

In a recent case, the grandparents lived in another state and wanted an order granting visitation rights with the minor child, despite the parent’s objections to such an order. The grandparent initially filed a petition in the county of which they lived, but the client argued that the Uniform Child Custody Jurisdiction Act allowing the action to be prosecuted in the State of Arizona. The client was correct, and the court ruled that Arizona was the minor child’s home state. Pursuant to
Arizona Revised Statutes § 25-409.

Visitation rights of grandparents and great-grandparents, the court ordered that under the circumstances, grandparent’s visitation was in the best interest of the minor child. When the client first, contacted us to prepare the petition, they had no idea that the matter would play out in Arizona because at one point, the minor lived in another State. The research that we provided enabled the grandparents to obtain the visitation rights they wanted. In fact, once we explained the rules for obtaining temporary orders for visitation, they decided that a request for temporary orders was in the child’s best interest.

The client made a single appearance in the Superior Court of Arizona, because we gathered the information from the client, prepared the petition, facilitated service of the petition and Motions for Temporary Orders! The clients maintained their freedom by allowing us to worry about the case process, while assisting them in understanding and following the rules.
