Guardianships
A Guardianship petition may be filed in any Maricopa County Arizona Superior Court, or Juvenile court with competent jurisdiction. Arizona Laws allows the court to appoint a guardian, in a variety of situations, including for minors or incapacitated persons. These types of actions can be complicated, so it is important to identify the status of the person for which the guardianship is requested. Adult Guardianships
In Maricopa County, Arizona a request for appointment of guardianship for an adult is processed through the administration of probate defined in Chapter 5 of the Arizona Revised Statutes §14-5102, 14-5301. The proper venue for such request is determined by the residence and location of the incapacitated person. Again these situations can be a bit complicated, because whenever necessary the court in most cases will appoint a “Guardian Ad Litem” for the incapacitated person. The person requesting Guardianship must be prepared to provide detailed information in support of the request for appointment.
Discharging Guardianships
Petitions to Discharge Guardianships for minors are required upon a minor reaching the age of 18, Marriage of a minor or as a result of his/her emancipation. For example, recent clients came to us after they had agreed to allow a third party to act as guardian for their minor child. After agreeing that the third party could act as guardian during a time of despair, the clients decided that they no longer needed this third party to act as guardian and hired us to file the discharge or petition to request termination of the guardian’s appointment. Annual Reports
Filing the Annual Report- After receipt of a guardianship, the court will require that an annual report is filed. If the report is about minor(s) the court will require a detailed description of the activities that the minor was involved in for the preceding year. Many of our clients keep detailed records of events and other activities that make filing the annual report an equivalent of reading a diary. We have provided our clients with detailed questionnaires and reminders of when the report is due.
