Income Determinations: May be necessary after a court has ordered the opposing party to pay spousal maintenance or child support. To determine what amount should be paid by the opposing party absent an order that prevents you from learning the opposition’s income you may file discovery motions or petitions to require the disclosure of the other party’s income. For, an explanation of the necessary disclosure visit the Arizona Revised Statutes §25-322.
Serving Papers: As you may or not know it, but initial verified complaints or petitions must be served in accordance with Rule 4 of the Arizona Rules of Civil Procedure or other court rules depending on the nature of the action or the jurisdiction employed. Rule 4 has several provisions and depending on the exact circumstance, you need to know which to employ. In some cases, to ensure compliance with rule 4 and to prevent the dismissal of your complaint or petition an alternative form of service must be requested. Mediation: In some cases the parties’ will agree to allow a mediator or other neutral party to assist their efforts to reach an acceptable resolution without intervention of the court. One of our recent clients decided to attempt mediation rather then have a judge determine what new custody arrangements should be. It worked out pretty well, the parties’ were able to reach an agreement that everyone involved believed was the best interest of the minor child. See: A.R.S. §25-381.09
Conciliation Services: Like mediation above, conciliation is similar the primary difference is that this service deals primarily with a Divorce. In some cases, the parties’ will determine that saving the marriage is the best thing under the circumstances. Arizona Law affords the parties’ the opportunity to reconcile the marriage. See: A.R.S. §25-381.23
Waiver or Deferral of Fees: Access to the court is very important no matter the circumstances. In Gideon v. Wainwright the United State Supreme Court found that a criminal defendant has a right to assistance of Counsel. Although in those Criminal Cases the Criminal Justice Act ensures that a criminal defendant has appropriate resources an/or counsel, civil cases and family law cases are not subject to the standards of Gideon. However, in certain circumstances, the court clerk is empowered to defer court fees and in some cases issue a waiver at the conclusion of the case.
